Privacy Statement

We value your privacy. In this privacy statement, we inform you about how we process personal data, the purposes for which we process personal data, how to exercise your privacy rights and other information about how we handle personal data.

 

Who are we?

ArxGroep B2B B.V. consists of the labels Partnerpete.com, Maandlasten Manager, ProPropertyPartners and DeOpnameApp and is part of ARX Groep Holding B.V. Personal data is processed through the services and/or products of these companies. ARX Groep Holding B.V. is registered with the Chamber of Commerce under number 65441877 and is located at Joop Geesinkweg 851, 1114 AB in Amsterdam.  ArxGroep Holding B.V. (hereinafter: ArxGroep) is the Controller with respect to the collection and use of your personal data within ArxGroep as set out in this privacy statement.

 

When do we collect your personal data?

We collect personal data from real estate professionals and potential customers on behalf of utility services. With the help of real estate professionals, such as real estate agents, we make it easy and convenient for people and organisations to get connected to utility services.  Real estate professionals who want to offer our services to their customers register with us. We use this data to perform the agreements and for marketing purposes. In addition, we offer real estate professionals an app (DeOpnameApp) to create check-in check-out forms  to offer their customers so they can have their utility services connected as well. Here, we also collect personal data. 

If a customer purchases a utility service through one of our labels, we collect personal data from the customer in order to mediate the supply contract with a utility company. We also collect data when someone contacts us (for example through our customer service), visits our websites or asks a question.

 

Which personal data do we process?

 

Real estate professional

We collect business contact details, address details, financial details, app usage details, contact and usage history from real estate professionals who offer ArxGroep services to their customers. When using the app (DeOpnameApp), we process name and email address and usage history. 

Customers for utility services

Among other things, we collect personal data when advising and mediating agreements between consumers and utility services, such as energy. This includes data such as your (company) name, gender, date of birth, address, contact details and bank account number. And also your current contract details, consumption details and connection details. 

We also process the personal data you provide us through the website, for example when you fill in the contact form or subscribe to our newsletter. This includes data such as name, telephone number and e-mail address. In addition to the personal data you provide us with, we may collect, record and process data about how you use our website(s). This includes data about the equipment used, such as a unique device ID, the version of the operating system and settings of the device you use to visit ArxGroep, as well as data about the use of our website, such as the time of day you visit us and the topics you view and interaction data such as IP address, surfing behaviour on the websites, click behaviour, location data and cookie ID. For what purposes do we process personal data?

We process personal data for the following purposes: 

Real estate professional 

  1. To provide services and to enable the professional to offer the services of the ArxGoep to customers or to use the app
  2. As a real estate professional you will have access to a personal login environment. Here you can register leads. For this purpose, we process your login details, any changes you make to your data and other data you provide us with in this context.
  3. To establish and maintain a relationship (CRM)
  4. To perform a debtor and creditor check
  5. For marketing purposes
  6. To optimise the performance of online web pages and the app;
  7. To perform analyses for the purpose of management information, product and service development, determining (general) strategy, as well as statistical and scientific purposes.

 

Customers of utility services 

  1. To advise and mediate in utility contracts
  2. To establish and maintain a relationship (CRM)
  3. As a customer of ArxGroep, you will have access to your personal environment. When you log in to your personal page, you will have an overview of all the products and services you have purchased through ArxGroep in one place. For this purpose, we process your login details, any changes you make to your data and other data you provide us with in this context.
  4. For marketing purposes
  5. To optimise the performance of online web pages and the app;
  6. To perform analyses for the purpose of management information, product and service development, determining (general) strategy, as well as statistical and scientific purposes.
  7. If you decide to write a review, you can choose whether to add your name or other personal details. We are curious about the opinions of our visitors, but reserve the right not to publish contributions that do not adhere to the terms and conditions of our website.
  8. If you respond to a promotion or competition, we will ask for your name, address and e-mail address. We use this information to carry out the promotion, announce the winner(s) and measure the response to our marketing campaigns. 

The legal bases for processing this data are:

  • for the performance of an agreement: for example, the actions we must perform in order to realise the connection to the supplier’s network;
  • to comply with a legal obligation: for example, the obligation to retain invoices for 7 years (for the Tax and Customs Administration). But also the obligations arising from the Anti-Money Laundering and Counter-Terrorist Financing Act (WWFT). For example, we must carry out (further) investigation if an unusual transaction is suspected;
  • on the basis of our legitimate interest: for example, to combat fraud, to conduct marketing activities or to improve our services;
  • on the basis of consent: for example, to send you personal offers (e.g., through our newsletter). 

 

Access, rectify or erase data

You have the right to:

  • Access your data;
  • Rectify your data;
  • Erase your data;
  • Object to the processing of your data;
  • Transfer your data;
  • Revoke consent;
  • Submit a complaint to the Dutch Data Protection Authority.

Data security

We have implemented technical and organisational measures to protect your personal data against unauthorised access, accidental or unlawful destruction, disclosure or any other form of unlawful processing. For example, your data is stored on secure servers. Where necessary, your data will be encrypted. We also ensure that our employees only have access to your data to the extent required for the performance of their duties.

 

Retention period of your data

We will not retain personal data any longer than necessary for the purposes listed above. The retention period depends on the purposes the personal data is used for. Once your personal data is no longer needed, it will be anonymised or deleted. Customers who use or have used a utility service via ArxGroep can delete their own account in ‘my environment’. An account that has not been used for more than two years will be deleted. 

 

Disclosure of data to third parties

ArxGroep does not sell your data to third parties and only provides this if necessary for the performance of our agreement with you, or in order to comply with a legal obligation. We have entered into a data processor agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. ArxGroep shall remain responsible for these processing operations. 

ArxGroep provides these companies only with data required for the provision of services. ArxGroep obliges the third parties ArxGroep shares personal data with to use it exclusively within the scope of the relevant service provision or to fulfil legal obligations. Furthermore, the service providers may act solely upon our instructions.

Although ArxGroep prefers to engage service providers in countries within the EEA where an adequate level of protection applies, the service providers engaged by ArxGroep may be located anywhere in the world. This may, therefore, involve transfer to third parties in countries that do not have a comparable level of protection of personal data to that which is applicable within the EEA. However, we will only do so if said third party can offer an adequate level of protection and security. For example, because the transfer of personal data takes place to a country which has been designated by the European Commission as having a comparable level of protection on the basis of an adequacy decision, or because the third party can make use of Binding Corporate Rules or by using Standard Contractual Clauses.

 

Cookies

ArxGroep uses cookies to personalise the website and make it more user-friendly. Cookies are small (text) files that are sent with pages of websites and are stored on your computer or smartphone to enable subsequent visits to our website.
